An annulment or nullity of marriage or domestic partnership is when the court declares your marriage or domestic partnership NOT legally valid. That is what everyone thought was a marriage, once annulled, was never one at all in the eyes of the law. There are a variety of legal reasons that can declare your marriage legally invalid.

The following are legal reasons for an annulment:

• A marriage is never legally valid when it is incestuous, when the two people are close blood relatives, or bigamous, when one person is in another marriage or registered domestic partnership with another person. These reasons make the marriage or domestic partnership automatically illegal.
• The age at the time of marriage or domestic partnership was under 18 years old at the time of the marriage or domestic partnership.
• When either party was already legally married or in a registered domestic partnership. In this case, different than bigamy, the marriage or domestic partnership took place after the former spouse or domestic partner was absent for 5 years and not known to be living.
• Either party was of “unsound mind” or unable to understand the nature and obligations of the marriage or domestic partnership.
• Either party got married or registered the domestic partnership as a result of fraud. Some examples are marrying only to get a green card.
• Either party consented to getting married or filing a domestic partnership as a result of force.
• If one of the persons was physically incapacitated or physically incapable of consummating the marriage or domestic partnership and the incapacity continues and/or appears to be incurable.
